Terms, Conditions and Policies
These Terms and Conditions (“Agreement”) govern the use of the facilities, services, and digital content of The Basement Cycle + Train (“Studio,” “we,” “us,” “our”). By accessing our physical premises or engaging in services (in-person or virtual), you (“Client,” “you,” “your,” “user”) accept and agree to be legally bound by this Agreement.
1. Assumption of Risk & Waiver of Liability
You acknowledge and agree that participation in fitness classes and the use of Studio facilities or digital services involves physical activity, which carries inherent risks including, but not limited to, personal injury, illness, or death.
By attending classes or using our facilities/services, you voluntarily assume all risks, and you release and discharge The Basement Cycle + Train, its owners, directors, employees, contractors, and affiliates from any and all liability, claims, or causes of action arising from your participation.
2. Health Declaration
You confirm that:
- You are physically and mentally able to participate in strenuous physical activity;
- You will get permission from your doctor or healthcare professional prior to class in order to participate if you have any health concerns, injuries, or are pregnant;
- You will not attend class if you are experiencing symptoms of illness or have tested positive for a communicable disease within a medically advised isolation period.
3. Height Requirement
Riders must be at least 4’ 11” to take cycle classes at The Basement Cycle + Train.
4. Bookings, Payments & Refund Policy
- All purchases of memberships, class packages, and drop-ins are final and non-refundable. Retail items returned within 7 days of purchase, tags attached and unworn/unused, can be exchanged or refunded to the same payment method.
- Bookings must be made via our official website, app, in-person, or by calling the studio.
- Cancellation windows are defined as follows:
- Classes must be cancelled at least 10 hours prior to the scheduled start time to avoid a loss of credit for class pack users or a $15 penalty for unlimited membership users.
- No-shows will be subject to a loss of credit for class pack users or a $20 fee for unlimited membership users.
- In order to avoid significant class disruption, you will not be allowed to enter class later than 5 minutes after the class start time.
- If you are not checked in 5 minutes before class starts, your spot may be given away to another client. If you are running late, please call the studio to let us know.
- New users must arrive 15 minutes before class starts so that we may get them prepared for class appropriately.
5. Minors
Clients must be 14 years of age or older to participate in classes and must be 18 years or older to create a user account. Registration of a Minor between the ages of 14-17 must be completed in person at our studio with a parent or guardian present. A waiver must be signed on behalf of any minor by a legal guardian prior to participation.
For private rides including minors such as for high school field trips or birthdays, waivers must be signed online or in-person by a parent or legal guardian of each minor between the ages of 14-17 before they may participate in the class. Individual accounts will not automatically be created for participants attending private rides, including minors.
6. Code of Conduct
Clients agree to:
- Treat staff, instructors, and fellow clients with respect and courtesy.
- Use equipment safely and responsibly.
- Follow studio protocols, hygiene standards, and instructor directions.
- Refrain from disruptive, abusive, or unsafe behavior.
Violation of this section may result in immediate suspension or termination of access without refund.
7. Recording, Media Release & Content Usage
You acknowledge and agree that from time to time, classes or sessions at The Basement Cycle + Train may be recorded (video and/or audio), photographed, or live-streamed for promotional or commercial purposes, including but not limited to:
- Social media marketing (Instagram, TikTok, Facebook, etc.)
- Website and digital advertising
- On-demand platforms or subscription-based services
By participating in our classes or being present in our studio, you grant The Basement Cycle + Train the irrevocable, worldwide, royalty-free license to use your likeness, voice, image, or performance in any media format, now or hereafter developed, for commercial or non-commercial purposes, without further compensation or consent.
If you do not wish to appear in any recorded media, you must notify the front desk prior to class. We will make reasonable efforts to accommodate, but cannot guarantee full exclusion from background footage.
8. Adult Content & Explicit Music
You acknowledge and agree that classes or sessions at The Basement Cycle + Train may include adult-oriented themes, mature subject matter, and/or explicit music. These themes and music may not appeal to all clients. Please let us know if you are adverse to this type of music or theme and we will do our best to direct you to classes and instructors that are a better fit for your taste.
9. Suspension & Termination
We reserve the right to suspend or terminate your membership, package, or access to services if:
- You breach these Terms;
- You behave in a manner deemed harmful or unsafe;
- You misuse studio property or violate applicable laws.
Such actions may be taken without notice and are non-refundable.
10. Privacy Policy & Data Collection
We collect personal information for the purposes of class registration, communication, payment processing, and marketing in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial laws.
Your information is stored securely and not shared with third parties except as required to deliver services (e.g., booking software). You may opt out of marketing communications at any time.
11. Intellectual Property
All digital content, class formats, brand materials, and recordings are the exclusive intellectual property of The Basement Cycle + Train. You may not reproduce, share, or distribute any class content or recordings without express written consent.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes your acceptance. The most current version will always be posted on our website.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein.
